What should I do if I have been dismissed?
- Check the grounds being invoked and the deadlines, because the exchange of formal notices decides much of the outcome and it moves fast. Keep your payslips, the notice itself and anything evidencing your duties, hours and length of service. Answering a formal notice badly, or not answering at all, costs money later.
What am I owed for a dismissal without cause?
- The base figure is one month of salary per year of service or fraction longer than three months, plus notice pay, the balance of the month of dismissal and accrued holiday. Penalties may be added on top where the employment was misregistered or not registered at all. The real figure depends on which salary is taken as the base, and that is usually where the whole argument sits.
What should I do after a workplace accident?
- Report the accident to the workers compensation insurer straight away and do not play down the injury. The insurer must provide medical treatment, and where the degree of incapacity it assigns does not reflect the real harm, that can be challenged. Time limits run from when the incapacity is determined, not from the accident itself.
Does the firm act for employers or for employees?
- For both, in separate cases. On the employer side the focus is preventive audit of employment files and contracts, and closing the dispute before interest inflates it. On the employee side, it is getting an accurate measure of what the claim is worth from the first formal notice.
